In October we wrote that the U.S. Department of Education (ED) is considering an open licensing requirement for direct competitive grant programs. If adopted, educational resources created with ED grant funds will be openly licensed for the public to freely use, share, and build upon.

The Department of Education has been running a comment period in which interested parties can provide feedback on the proposed policy. Creative Commons has drafted a response, which discusses the open licensing policy and other questions proposed by ED. You too can share your thoughts with ED–here’s a guide about how to do it. The deadline is December 18. Submit your comments now!

We think the adoption of an open licensing requirement is useful because it clarifies the rights of the public in how we may all access, use, and adapt ED-funded resources.

The license must be worldwide, non-exclusive, royalty-free, perpetual, and irrevocable, and must grant the public permission to access, reproduce, publicly perform, publicly display, adapt, distribute, and otherwise use, for any purposes, copyrightable intellectual property created with direct competitive grant funds, provided that the licensee gives attribution to the designated authors of the intellectual property.

We think ED should include a specific mention that the open license definition they provide most closely aligns with the permissions and conditions of the Creative Commons Attribution International 4.0 license (CC BY). This way, it will be clear to grantees which open license ED requires them to use.

It’s good to see the Department of Education proposing a similar rule that the Department of Labor introduced several years ago with their community college and career training grant program. That $2 billion grant pool required that educational resources created with Department of Labor grant funds be licensed under the CC BY license. By doing so, the Department of Labor made sure that the resources created with its grant funds can be easily discovered and legally reused and revised by the public.

If you could send a folder with 50 MB of content to every human on Earth, what would you include? This weekend Creative Commons volunteers and Outernet are hosting a CC Content Edit-a-thon to populate the first Outernet library to be broadcast from space. The edit-a-thon will take place at Mozilla Festival East Africa (MozFestEA) in a weekend-long track that will be kicked off Saturday morning by Outernet and CC volunteers from Uganda and Kenya. During the first hour, Outernet will introduce the initiative and set guidelines, and CC volunteers will provide basic knowledge and training about how and where to find open content. This first hour will be recorded and posted to the Outernet wiki and Outernet’s YouTube channel so that anyone in the world may participate.

Remote participation from anywhere in the world is encouraged! Here’s how you, your friends and colleagues can participate:

  • Tell people about it! Send them to this blog post, or this one by Outernet, or http://editathon.outernet.is and tweet using #LibraryFromSpace.
  • Re-post this on your own blog – this blog post is public domain (CC0).
  • Register (free) to help Outernet anticipate the number of participants.
  • Come to a physical edit-a-thon. In addition to the MozFestEA session in Kampala, Uganda, CC volunteers in Guatemala will host their own satellite edit-a-thon to start building a CC library in Spanish for Latin America. CC volunteers in Nigeria will participate remotely as well.
  • On 18-19 July, head over to the Outernet wiki: https://wiki.outernet.is/wiki/Outernet_Wiki. Video, guidelines, directions, and the links to where you’ll be curating, creating, and editing open content will all be here. In addition, Outernet is working on its CC platform integration to provide options for individuals who want to release their content into the public domain (via CC0) or under CC licenses.

Outernet and CC volunteers are building a library that everyone can enjoy, even without an Internet connection. Be one of the first to put content on its shelves!

Today the Ford Foundation announced an open licensing policy for all of their grant-funded projects and research. The new arrangement came into effect February 1, 2015 and covers most grant-funded work, as well as the outputs of consultants. The Ford Foundation has chosen to adopt the CC BY 4.0 license as the default for these materials. Grant agreements will now include a paragraph requiring the grant recipient to broadly share all copyrightable products (such as research reports, photographs, videos, etc.) funded by the grant under CC BY. And the Ford Foundation is leading by example by adopting CC BY for all materials not subject to third-party ownership on their own website.

Darren Walker, president of the Ford Foundation, said, “This policy change will help grantees and the public more easily connect with us and build upon our work, ensure our grant dollars go further and are more impactful, and – most importantly – increase our ability to advance social justice worldwide.”

“We’re incredibly pleased to see the Ford Foundation adopting a Creative Commons licensing policy for a wide range of grant-funded works, promoting openness and re-use of content produced through its philanthropic grantmaking,” said Ryan Merkley, CEO of Creative Commons. “The Ford Foundation joins a growing movement of foundations and governments adopting policies that increase access to and re-use of digital education materials, research articles, and data using Creative Commons.”

The Ford Foundation is an independent, nonprofit grant-making organization created in 1936. Its mission is “to strengthen democratic values, reduce poverty and injustice, promote international cooperation, and advance human achievement.” In 2013 the Ford Foundation granted almost $570,000,000 to projects and organizations around the world.

The Ford Foundation joins several other philanthropic grantmaking organizations who have adopted Creative Commons licensing policies for the outputs of their charitable giving. We’ve highlighted several over the last few months, including the William and Flora Hewlett Foundation (who also now require CC BY for all their project-based grantmaking) and the Bill & Melinda Gates Foundation (who adopted a CC BY open access policy for published grant-funded research and data). Releasing grant-funded content under permissive open licenses like CC BY means that these materials can be more easily shared and re-used by the public. And they can be combined with other resources that are also published under an open license.

Congratulations to the Ford Foundation on adopting an open licensing policy that will encourage the sharing of rich content and data in the digital global commons. Creative Commons continues to urge other foundations and funding bodies to emulate the ongoing leadership of the Ford Foundation by making open licensing an essential component of their grantmaking strategy.

The newly founded K-12 OER Collaborative has released an RFP for the creation of open educational resources (OER) in mathematics and English language arts and literacy. As all content developed under this RFP will be openly licensed under CC BY 4.0, U.S. states, territories and school districts (and anyone else in the world) may freely reuse, revise, remix, redistribute and retain these educational resources.

Forty-three US States + Washington DC + Guam + American Samoan Islands + US Virgin Islands + Northern Mariana Islands (map) have adopted the Common Core State Standards (CCSS)… and they all need current, high quality, affordable, CCSS-aligned educational resources for their students, teachers, parents and districts.

Will these US States and territories have the public funds necessary to update educational resources (including textbooks) for these two subjects?

According to the Association of American Publishers school districts across the U.S. spend over $8 billion on instructional materials every year. Textbooks quickly fall into disrepair, students are not allowed to write in or keep their books as they graduate each grade, and teachers are not legally and technically empowered to update outdated educational resources. In addition, much of this spending is on costly, yearly subscription fees for digital content which school districts merely lease (not own).

This aggregate demand represented by the nationwide need for new CCSS-aligned educational materials creates a unique opportunity for states to acquire higher quality, more effective content in a smarter, far less expensive, and far more flexible manner, and make these resources available to teachers, parents and districts. Specifically, states and districts can transition from expensive and rigidly controlled materials to OER.

The RFP specifically seeks complete courses for the following grades and subjects:

  • K–2 English Language Arts/Literacy
  • 3–5 English Language Arts/Literacy
  • 6–8 English Language Arts/Literacy
  • 9–12 English Language Arts/Literacy
  • K–5 Mathematics
  • 6–8 Mathematics
  • 9–12 Mathematics — Integrated/International Pathway (Secondary Mathematics I, II, III)
  • 9–12 Mathematics — Traditional Pathway (Algebra 1, Geometry, Algebra 2)

Courses will be designed to meet Common Core State Standards, accessibility standards, technical specifications, and an open licensing requirement of CC BY 4.0 on all new content produced. For details on the development process, see the complete RFP.

Philanthropic foundations fund the creation of scholarly research, education and training materials, and rich data with the public good in mind. Creative Commons has long advocated for foundations to add open license requirements to their grants. Releasing grant-funded content under permissive open licenses means that materials may be more easily shared and re-used by the public, and combined with other resources that are also published under open licenses.

Yesterday the Bill & Melinda Gates Foundation announced it is adopting an open access policy for grant-funded research. The policy “enables the unrestricted access and reuse of all peer-reviewed published research funded, in whole or in part, by the foundation, including any underlying data sets.” Grant funded research and data must be published under the Creative Commons Attribution 4.0 license (CC BY). The policy applies to all foundation program areas and takes effect January 1, 2015.

Here are more details from the Foundation’s Open Access Policy:

  1. Publications Are Discoverable and Accessible Online. Publications will be deposited in a specified repository(s) with proper tagging of metadata.
  2. Publication Will Be On “Open Access” Terms. All publications shall be published under the Creative Commons Attribution 4.0 Generic License (CC BY 4.0) or an equivalent license. This will permit all users of the publication to copy and redistribute the material in any medium or format and transform and build upon the material, including for any purpose (including commercial) without further permission or fees being required.
  3. Foundation Will Pay Necessary Fees. The foundation would pay reasonable fees required by a publisher to effect publication on these terms.
  4. Publications Will Be Accessible and Open Immediately. All publications shall be available immediately upon their publication, without any embargo period. An embargo period is the period during which the publisher will require a subscription or the payment of a fee to gain access to the publication. We are, however, providing a transition period of up to two years from the effective date of the policy (or until January 1, 2017). During the transition period, the foundation will allow publications in journals that provide up to a 12-month embargo period.
  5. Data Underlying Published Research Results Will Be Accessible and Open Immediately. The foundation will require that data underlying the published research results be immediately accessible and open. This too is subject to the transition period and a 12-month embargo may be applied.

Trevor Mundel, President of Global Health at the foundation, said that Gates “put[s] a high priority not only on the research necessary to deliver the next important drug or vaccine, but also on the collection and sharing of data so other scientists and health experts can benefit from this knowledge.”

Congratulations to the Bill & Melinda Gates Foundation on adopting a default open licensing policy for its grant-funded research. This terrific announcement follows a similar move by the William and Flora Hewlett Foundation, who recently extended their CC BY licensing policy from the Open Educational Resources grants to now apply foundation-wide for all project-based grant funds.

Regarding deposit and sharing of data, the Gates Foundation might consider permitting grantees to utilize the CC0 Public Domain Dedication, which allows authors to dedicate data to the public domain by waiving all rights to the data worldwide under copyright law. CC0 is widely used to provide barrier-free re-use to data.

We’ve updated the information we’ve been tracking on foundation intellectual property policies to reflect the new agreement from Gates, and continue to urge other philanthropic foundations to adopt open policies for grant-funded research and projects.

Last month, I had the honour of providing a keynote address and two workshops at a teacher conference at Northcote College1, on the North Shore of Auckland, New Zealand.

Like many schools, Northcote is in the process of developing an overarching digital citizenship policy for staff, students, and the wider community. This policy is likely to include – alongside other issues like safety, privacy, research and integrity – a commitment to Creative Commons licensing.

If Northcote College does adopt a Creative Commons policy, they will join between fifty and one hundred New Zealand schools that have decided to formally give permission for teachers to share resources using a Creative Commons licence, with a preference for CC BY and CC BY-SA.

The policy is designed to address the fact that, under Section 21 of the 1994 Copyright Act, the first owner of copyright works made by New Zealand teachers in the course of their employment is their employer – namely, the schools governance board, known as the ‘Board of Trustees’ (BoT).

This means that teachers who share resources they make are legally infringing the school’s copyright – even when they are sharing with other teachers in the New Zealand state education system.

We’re advocating two solutions to this problem. First, we think every school in New Zealand’s pre-tertiary education system – all 2,500 of them – should pass a Creative Commons policy. This policy allows – and encourages – teachers to share their resources with other teachers under a Creative Commons licence.

Second, we think that teachers should adopt practices of finding, adapting, and sharing open content into their workflow. This will give teachers more confidence and flexibility when re-using third-party resources, and provide more resources for other teachers to build on and reuse.

We’ve been working at this for a couple of years now, spreading the word to the many groups working in the sector, including teachers, principals, Boards of Trustees, unions, disciplinary associations, public agencies, and other NGOs.

It’s been a long campaign, but we’re starting to make real progress. We’re giving an average of forty talks and workshops per year to the education sector, and we’re currently looking for ways to scale this work to meet the needs of every school in the country. This will become increasingly important as new resource sharing platforms – such as the crown-owned Network for Learning’s Pond – begin to take off.

The other challenge is to follow the lead of other CC affiliates, such as Poland, and help open up works produced or contracted by the Ministry of Education. There are signs that more of these resources will be openly licensed.

The adoption of open policy in schools coincides with similar moves in the local heritage and research sectors, and follows the continuing integration of CC licensing in central government. While there is still plenty to be done, it appears as if open licensing is on the verge of becoming mainstream across New Zealand’s public institutions – which is definitely good news for the global commons.

ABC of Copyright for Librarians in Latin America, or ABC del derecho de autor para bibliotecarios de América Latina, is a free, online course that launches today as part of the School of Open. This Spanish language course seeks to help librarians and library users strengthen their knowledge of copyright laws in Latin America and the challenges that exist to access to information in the 21st century.

From the launch announcement:

Public library seeks to provide equal opportunities in access to information, knowledge, recreation, culture, education, reading and writing for all their users. However, there are currently no minimum guarantees that allow libraries and archives carrying out activities related to their mission such as lending books or changing the format of a film (e.g. VHS to digital) for preservation purposes. For decades, protections for authors and/or rightsholders have been increased, while the guarantees of access and inclusion of copyright balances are at the mercy of political will.

This imbalance occurs especially in developing countries, as many developed countries have already generated standards seeking to better balance copyright.

To address these challenges, CC affiliates from Colombia, El Salvador and Uruguay, in collaboration with the Karisma Foundation, have developed a course for librarians, archivists, educators, university researchers, and anyone else in the Latin American region interested in these issues. ABC of copyright for librarians in Latin America is designed to strengthen the understanding of basic copyright concepts through examples, analysis and open models based on Latin American cases and legislation.

The course officially launches online on Internet Activa at 5pm Colombia time today (UTC-5). You can join the launch by filling out this form expressing your intent; however, registration to participate in the course is not required.

The course is also available as part of the School of Open as a self-paced course that can be taken at any time, licensed CC BY.

WindTech TV, a collection of wind turbine technician training materials and simulation modules, is now available under a CC BY license. Developed as part of a National Science Foundation (NSF) Advanced Technological Education project, WindTech TV’s modules are aligned with industry standards and designed to be integrated into two-year college wind technology programs to sustain workforce development in the field of wind power.

Modules are currently being used by community colleges across the United States, and Principal Investigator Phil Pilcher wants to expand that impact through reuse by other grantees, including those part of the U.S. Department of Labor’s $2 billion Trade Adjustment Assistance Community College & Career Training (TAACCCT) grant program.

“WindTechTV has always been free, but we think that the CC BY license will increase usage. One of our project goals is to disseminate the materials nationwide. The CC license lets instructors and administrators know that they can use our videos as they wish when they are developing and delivering courses. Also, TAACCCT grantees who are working on alternative energy courses will now be able to reuse our video content, which should speed up development.”

All modules are available at http://www.windtechtv.org and videos are available from WindTech TV’s YouTube channel.

To support these and other emerging open policy efforts, CC is about to launch, with multiple global open organizations, an Open Policy Network and Institute for Open Leadership.

The U.S. Department of Labor (DOL) has led the way in using open policy requirements in solicitations for grant requirements first with its Career Pathways Innovation Fund Grants Program (http://www.doleta.gov/grants/pdf/SGA-DFA-PY-10-06.pdf), then with its Trade Adjustment Assistance and Community College Career Training grant program (doleta.gov/taaccct). Now they are once again requiring the Creative Commons Attribution (CC BY) license on all content created with the grant funds and modifications made to pre-existing, grantee-owned content using grant funds in their Ready to Work Partnership grant program. Bravo!

The U.S. Department of Labor has announced the availability of approximately $150 million in funds for the H-1B Ready to Work Partnership grant program. DOL expects to fund approximately 20-30 grants with individual grant amounts ranging from $3 million to $10 million. This grant program is designed to provide long-term unemployed workers with individualized counseling, training and supportive and specialized services leading to rapid employment in occupations and industries for which employers use H-1B visas to hire foreign workers. http://www.doleta.gov/grants/pdf/SGA_DFA_PY_13_07.pdf

Here is the open policy text in the grant solicitation:

    • To ensure that the Federal investment of these funds has as broad an impact as possible and to encourage innovation in the development of new learning materials, as a condition of the receipt of a Ready to Work grant, the grantee will be required to license to the public all work (except for computer software source code, discussed below) created with the support of the grant under a Creative Commons Attribution 4.0 (CC BY) license. Work that must be licensed under the CC BY includes both new content created with the grant funds and modifications made to pre-existing, grantee-owned content using grant funds.

 

 

    • Questions about CC BY as it applies to specific Ready to Work grant applications should be submitted to DOL to the Grants Management Specialist specified in Section VII.

 

    • Only work that is developed by the grantee with the grant funds is required to be licensed under the CC BY license. Pre-existing copyrighted materials licensed to, or purchased by the grantee from third parties, including modifications of such materials, remain subject to the intellectual property rights the grantee receives under the terms of the particular license or purchase. In addition, works created by the grantee without grant funds do not fall under the CC BY license requirement.

 

    • The purpose of the CC BY licensing requirement is to ensure that materials developed with funds provided by these grants result in Work that can be freely reused and improved by others. When purchasing or licensing consumable or reusable materials, grantees are expected to respect all applicable Federal laws and regulations, including those pertaining to the copyright and accessibility provisions of the Federal Rehabilitation Act.

 

    • Further, the Department requires that all computer software source code developed or created with Ready to Work grant funds will be released under an intellectual property license that allows others to use and build upon them. Specifically, the grantee will release all new source code developed or created with grant funds under an open license acceptable to either the Free Software Foundation and/or the Open Source Initiative.

 

    • Separate from the CC BY license to the public, the Federal Government reserves a paid-up, nonexclusive and irrevocable license to reproduce, publish, or otherwise use, and to authorize others to use for Federal purposes: the copyright in all products developed under the grant, including a purchases ownership under an award (including, but not limited to, curricula, training models, technical assistance products, and any related materials).

Fixing-the-Broken-Textbook-Market

The U.S. PIRG Education Fund released a report this week called, “Fixing the Broken Textbook Market: How Students Respond to High Textbook Costs and Demand Alternatives.” The report features responses to a survey administered to over 2,000 students across 163 college campuses in the U.S. in regards to the rising cost of textbooks and how it affects student usage and academic performance. The report has been making the rounds in major news outlets and is highlighted in a letter to Congress by Senators Durbin and Franken as a push for the Affordable College Textbook Act. It is available for anyone to read online under the Creative Commons Attribution (CC BY) license, but here are the tl;dr highlights:

What the survey results say

  • 65% of students choose not to buy a college textbook because it’s too expensive
  • 94% report that they suffer academically because of this choice
  • 48% say they altered which classes they took based on textbook costs, either taking fewer classes or different classes
  • Senator Durbin wholeheartedly agrees: “According to the students surveyed in this report, the rising cost of textbooks not only adds to the overall financial burden of attending college, it can also have a measurably negative impact on their academic performance and student outcomes.”
  • 82% of students say they would do significantly better in a course if the textbook were free online and a hard copy was optional!
  • Case studies at both Houston Community College and Virginia State University suggest that classes using open textbooks have higher grades and better course completion rates

Textbook industry facts

(as reported by the U.S. PIRG Education Fund and the Student PIRGs)

  • College textbook prices have increased by 82% in the past ten years, aka 3x the rate of inflation
  • Though alternatives to the new print edition textbooks exist, the costs of these alternatives (such as rental programs, used book markets and e-textbooks) are still dictated by publishers who re-issue editions every few years
  • Ethan Sendack at U.S. PIRG says: “[Students] can’t shop around and find the most affordable option, meaning there’s no consumer control on the market.”
  • On average students spend $1,200 a year on textbooks which = 14% of tuition at a four-year, public college; 39% of tuition at community college

Open textbook facts

  • Open textbooks are written by faculty and peer-reviewed like traditional textbooks
  • Open textbooks are free to access, use, download to electronic devices, and affordable to print — all thanks to the open content licenses on them that legally allows these uses
  • U.S. PIRG estimates that open textbooks could save each student ~$100 per course they take
