Examples of entitlement in the following topics:

• The Budgeting Process

  • Social Security and Medicare are sometimes called "entitlements," because people meeting relevant eligibility requirements are legally entitled to benefits, although most pay taxes into these programs throughout their working lives.
  • Some programs, such as Food Stamps, are appropriated entitlements.
  • Some mandatory spending, such as Congressional salaries, is not part of any entitlement program.

• Federal Mandates

  • Certain changes in large entitlement programs refers to instances when new conditions or reductions in large entitlement programs, providing $500 million or more annually to state or local governments, are imposed by the federal government.

• Eligibility

  • Republican presidential candidate Mitt Romney was born in Mexico to American parents, illustrating that natural born citizenship does not depend on place of birth, but rather whether one is entitled to citizenship at birth.
  • Generally, however, natural born citizenship is understood to include anyone who is entitled to U.S. citizenship at birth, even if they are born outside of the U.S.

• The 23rd Amendment

  • A number of electors of President and Vice President equal to the whole number of Senators and Representatives in Congress to which the District would be entitled if it were a State, but in no event more than the least populous State; they shall be in addition to those appointed by the States, but they shall be considered, for the purposes of the election of President and Vice President, to be electors appointed by a State; and they shall meet in the District and perform such duties as provided by the twelfth article of amendment.

  • The budget resolution establishes budget totals, allocations, entitlements, and sometimes includes reconciliation instructions to certain House or Senate committees.

• The Sixth Amendment and the Right to Counsel

  • Williams, 430 U.S. 387 (1977), the right to counsel means "at least that a person is entitled to the help of a lawyer at or after the time that judicial proceedings have been initiated against him, whether by formal charge, preliminary hearing, indictment, information, or accusation."
  • The New Jersey Supreme Court unanimously held that, regardless of whether the proceeding is labeled as civil, criminal, or administrative, if a defendant faces a loss of liberty, she or he is entitled to appointed counsel if indigent.

• The Right to Due Process

  • This protection extends to all government proceedings that can result in an individual's deprivation, whether civil or criminal in nature, from parole violation hearings to administrative hearings regarding government benefits and entitlements to full-blown criminal trials.
  • To put it more simply, where an individual is facing a deprivation of life, liberty, or property, procedural due process mandates that he or she be entitled to adequate notice, a hearing, and a neutral judge.
